US judge weighs perjury as Fumo sentencing nears



A federal prosecutor says the only way to interpret the guilty verdict for former Pennsylvania state Sen. Vincent Fumo is that he perjured himself during the trial.

The judge sentencing Fumo next week plans to rule Thursday on whether Fumo perjured himself.

The jury found that Fumo used staff and resources of the Senate and nonprofits for personal and political chores. Fumo argued they did the work on their own time. Assistant U.S. Attorney Robert Zauzmer says the jury's verdict shows that was a lie.

The judge must also calculate the extent to which the multimillionaire Philadelphia Democrat defrauded the state Senate and two nonprofits.

Prosecutors put the total at more than $4 million. Fumo's lawyers are trying to whittle away at the figure to avoid a harsher sentence that applies to frauds of more than $2.5 million.
